International Conference on Air Law to celebrate the 85th anniversary of the Warsaw Convention

On 24 October 2014, at the Royal Castle in Warsaw the “International Air Law Conference – 85th Anniversary of the Warsaw Convention" was held. The conference was organized in connection with the celebration of the 85th anniversary of the signing of the Warsaw Convention of 1929. The event was participated by international aviation law experts, representatives of the Universities and experts from law firms and institutions which are involved in the aviation insurance sector.

The Conference was opened by the Undersecretary of State in the Ministry of Infrastructure and Development Mr Zbigniew Klepacki, who emphasized in his speech the importance of the Warsaw Convention system in the international air law and expressed his joy that the conference was held in exact place where 85 years earlier the deliberations over the text of the conventions were conducted. As part of the opening of the conference Mr Piotr Ołowski, President of the Civil Aviation Authority made his opening speech. He thanked the co-organizer "Polish Airports State Enterprise" and partners: Boeing, LOT Polish Airlines and PZU, as well as all the guests and speakers for coming to the conference. In his speech, he stressed that 2014 is a year of significant anniversaries, which marks not only the 85th anniversary of the Warsaw Convention, but also the 70th anniversary of the Chicago Convention, and the 100th anniversary of the first passenger flight, which took place from St. St. Petersburg to Tampa, Florida. The opening session of the conference ended with a speech from the Chief Executive of the “Polish Airports” State Enterprise Mr. Michał Kaczmarzyk, who emphasized the importance of the event and wished all participants a successful and fruitful conference.

The conference was divided into four panels, and moderated by Dr. Małgorzata Polkowska, the Permanent Representative of the Republic of Poland on the ICAO Council. The first panel was moderated by prof. Dr. Pablo Mendes de Leon - Director of the Institute of International Law and Space at Leiden University in the Netherlands. The panel was devoted to the issues and challenges for the global system of Warsaw Convention on the liability of carriers. As part of the panel the presentations were presented by Ms. Casati-Ollier Maylis - Clyde and Co, prof. Laura Pierallini - Studio Legale Pierallini, Mrs. Sonja Radosevic - Peljhan, Prelesnik & Partners, Ms. Noura Rouissi - European Commission and Mr. Sebastian Mikosz - President of the LOT Polish Airlines. The second panel on the responsibility of manufacturers and lessors of aircraft, engines and aircraft parts was moderated by prof. Paul Dempsey - Director of the Institute of Aerospace Law at McGill University in Canada. Among the panelists were Dr. Nikolai Ehlers - Ehlers & Partner, Edyta Michalak - MMMLegal, Mr. Alexander Uros Kosenina - GE Capital Aviation Services and prof. Stanislaw Sołtysiński - SK & S. The third panel, during which the issues of liability of providers of air navigation services and the airports were presented was moderated by prof. Francis Schubert – Skyguide. Among speakers were prof. Ludwig Weber - McGill University, Mr. Maciej Rodak - Polish Air Navigation Services Agency and Mr. Peter Tannhauser - EUROCONTROL. The last, fourth panel was devoted to the development of accountability issues in aviation and aviation insurance issues. The panel was moderated by Ms. Ulla Norrhall - Munich Re. The speakers of the panel were Prof. Stephan Hobe, Director of the Institute of Air Law and Space, University of Cologne, prof. Vincent Correia - University Paris Sud/University of Poitiers, Mr. Thomas Suska - PZU and Piotr Molenda - Warta.

The conference was a great opportunity to exchange experiences on the liability of aviation entities from the perspective of regulators, the University community and law firms, and to outline the challenges facing the aviation industry. The conference was closed by prof. Paul Dempsey, who summarized the issues raised during the conference. During the conference there was presented an exhibition devoted to the Warsaw Convention – which will be donated to ICAO and showed at the headquarters of the International Civil Aviation Organization (ICAO) in Montreal.
