New EU Law

On November 25, 2011, in the Official Journal of the European Union was published the Commission Regulation (EU) No 1178/2011 of 3 November 2011 laying down technical requirements and administrative procedures related to civil aviation aircrew pursuant to Regulation of the European Parliament and of the Council ( EC) No 216/2008 of 20 February 2008 (Dz. U. L 311, 25.11.2011, p.1) (the Air Crew Regulation).


The regulation includes a new, common to all Member States of the European Union, regulations in the field of training, examination, aero-medical examinations and licensing of pilots and cabin crew.


Regulation (EU) No 1178/2011 has been amended and supplemented by Regulation (EU) No 290/2012 of 30 March 2012 amending Regulation (EU) No 1178/2011 laying down technical requirements and administrative procedures relating to civil aviation aircrew in accordance with Regulation of the European Parliament and Council Regulation (EC) No 216/2008 (Dz. U. L 100, 5.4.2012, p.1).On December 15 2011, the EASA Executive Director with Decision No: 2011/015/R and 2011/016/R introduced the use of explanatory material and Consulting (AMC and GM) to the requirements set out in Annex IV (known as Part-MED) and Annex I (Part-FCL) to Regulation (EU) No 1178/2011.


On 19 April 2012, the EASA Executive Director with Decision No: 2012/005/R, 2012/006/R and 2012/007/R introduced the use of explanatory material and Consulting (AMC and GM) to the requirements of Annex V (Part -CC), Annex VI (Part-ARA) and Annex VII (Part-ORA) to EC Regulation 1178/2011.Mentioned above decisions of the Executive Director of EASA together with their annexes have been translated into Polish and published in the Official Journal of the CAA in guidance of the President of the Civil Aviation Authority: No. 3 dated 16 July 2012 (Item 67) and No. 5 dated September 20, 2012, the (Item 89).AMC and GM to describe possible ways of satisfying the applicable requirements of Regulation (EU) nr.1178/2011 and are designed to facilitate and standardize the activities of the entities applying for the certificate in the training of aviation personnel. Direct application of the proposed AMC and GM principles, methods, and measures will be most effective and efficient way to meet the EU requirements.

 

Amended and supplemented by Regulation (EU) No 1178/2011 now includes seven attachments:
a Appendix 1: Part-FCL (requirements for flight crew members)
b Annex 2: Terms of converting national licenses and aircraft and helicopter ratings,
c Appendix 3: Conditions for recognition of licenses issued by third countries or on their behalf,
d Appendix 4: Part-MED (medical requirements)
e Appendix 5: Part-CC (requirements for cabin crew)
f Appendix 6: Part-ARA (requirements for authorities)
g Appendix 7: Part-ORA (requirements for training organizations, FSTD operators and medical centers).
