New EU law


Please note that in accordance with Art. 10 paragraph 2 of the Commission Regulation (EU) 965/2012 of 5 October 2012 laying down technical requirements and administrative procedures related to air operations in accordance with the Regulation of the European Parliament and Council Regulation (EC) No 216/2008 of the Republic of Poland intends to notify the European Commission and EASA not to apply the provisions of Annex IV to Commission Regulation (EU) No 965/2012 to 28 October 2014

All AOC certificates issued in accordance with Regulation (EEC) No 3922/91 (aircraft) or JAR-OPS 3 (helicopters), valid at the date of entry into force of the Commission Regulation (EU) 965/2012 shall remain valid until their date of expiry, but no later than until 28 October 2014

The new OPS rules

On 25/10/2012 the European Commission published Commission Regulation (EU) No 965/2012 of 5 October 2012 laying down technical requirements and administrative procedures related to air operations in accordance with the Regulation of the European Parliament and Council Regulation (EC) No 216 / , 2008. (Official Journal of the EU L 296 of 25 October 2012).

This Regulation lays down detailed rules for commercial air transport operations by airplanes and helicopters, including the ramp inspections of aircraft operators which are under the supervision of the security exercised by the other country, when they are at airports situated on the territory subject to the provisions of the Treaty.

This Regulation lays down the detailed rules for the issuing, maintaining, amending, limiting, suspending or revoking the certificates of aircraft operators referred to in Art. 4 paragraph 1 point. b) and c) of Regulation (EC) No 216/2008, and which are used for commercial air transport operations, laws and duties of holders of certificates and the conditions under which operations shall be prohibited, limited or subject to certain conditions in the interest of safety .

This Regulation shall enter into force on the 3rd day after publication.

The Regulation contains five annexes:

Annex I - Definitions of terms used in Annexes II to V
Annex II - Official requirements for air operations (Part-ARO)
Annex III - Organizational requirements for air operations (Part-ORO)
Annex IV - Commercial air transport operations (Part-CAT)
Annex V - Specific approval (Part-SPA)
