Instructors conducting training in the transport of dangerous goods

Definition of Instructor

According to Article 2 points 4 of the Act of August 5, 2022 on the transport of dangerous goods by air, an instructor is a person referred to in art. 22 paragraph 1. According to Article 22 paragraph 1 to conduct training, is entitled a person who has been approved by the President of the Civil Aviation Authority to meet the requirements for conducting training of safe transport of dangerous goods by air.

Approval:

Based on Article 23 of the Act, the President of the Civil Aviation Authority grants approval for the period of validity of the training resulting from the document confirming the successful completion of the training as well as after positive verification of the submitted attachments to the application. The approval specifies the content of the training that the instructor may provide with regard to the trained tasks and the method of training. The approval shall be made in writing and served on personally or by fax, and if the applicant indicates such an address for service - to the electronic address. To obtain approval, a person submits an application to the Civil Aviation Authority along with the following documents: Application for download: docxApplication_for_Instructors582.08 KB

According article 22 of the Act of August 5, 2022 on the transport of dangerous goods by air, application must be accompanied by the following documents:

  • a document confirming that the applicant has completed successfully training in accordance with the requirements of the Technical Instructions (TI Doc9284);

Document confirming completion of the training issued before 01/10/2022 – must meet the requirements specified in the ICAO Technical Instruction DOC 9284 :

  • The individual`s name
  • The most recent training completion month
  • A description, copy or reference to training materials used to meet the training requirements
  • The name and address of the organization providing the training
  • Evidence which shows that a test has been completed satisfactorily

Document confirming completion of training issued after 01/10/2022 – must meet the requirements of the Act of  August 5th, 2022 on the transport of hazardous materials by air, Article 21 point 9:

  • Name and last name
  • Instructor`s name and last name
  • Date and place of training
  • The scope of the training program as defined in the Technical Instruction
  • Information about the exam result – percentage
  • a document confirming:
  1. at least 3 years of experience of the applicant in the work associated with dangerous goods – this concerns applicants applying to conduct training for airline and ground handling personnel who accept dangerous good,

           Document confirming 3 years of experience, it may be:

  • Employment certificate
  • Employer references
  • Invoice or correspondence indicating the work performed
  • Letters of reference of the companies with which the entity cooperated
  • Responsibilities from the employer

Documents not accepted:

  • CV
  • Statement
  • Declaration
  1. at least 1 year of experience of the applicant in the work associated with dangerous goods - a candidate applying to conduct training for other trainings;

Document confirming  1-year of experience, it may be:

  • Employment certificate
  • Employer references
  • Invoice or correspondence indicating the work performed
  • Letters of reference of the companies with which the entity cooperated
  • Responsibilities from the employer

Documents not accepted:

  • CV
  • Statement
  • declaration
  • documents confirming the applicant’s skills in teaching, for ex.: certificates or other documents confirming having training skills in practice, that may be :
  • train the trainer
  • pedagogical studies
  • didactic courses
  • documented certificates confirming the skills in transferring knowledge
  • framework training program that includes:
  1. the scope of the training,
  2. a description, methods and materials used to meet the training,
  3. requirements, specified in article 21 paragraph 2 subparagraph 5, with sample examination tests,
  4. criteria of successfully accomplished training.
  • payment confirmation.

(according article 42 paragraph 6 of the Act - The amount of the fee for official activities performed by the President of the Civil Aviation Authority in connection with granting the approval - is 600 PLN.)

Invoices, bills & certificates

Fees paid to the Civil Aviation Authority including the fee for official activities - are non-tax budgetary charges, which are paid by the CAA to the state budget. They are submitted on the basis of applicable law and the act of 5 August 2022 on the transport of dangerous goods by air, which sets out the rules and procedure for their submission, which is the basis of these payments. These fees are not collected in connection with the conducted business activity, because the Civil Aviation Authority does not conduct such fees, but in connection with the statutory designation of the ULC as a government administration body competent for their collection. For the above reasons, no invoices, bills or certificates are issued in relation to the fees paid to the CAA - as is the case with other public levies (eg. in respect of personal or corporate income tax).

Formal shortcomings of the application and the attached documentation:

According to Art. 64 of the Act of June 14, 1960 - of the Code of Administrative Procedure, in the event that the applicant's address is not indicated and it is impossible to determine the address on the basis of the data held, the application shall not be examined.

In the event of finding formal deficiencies, applicant will be requested to remedy these deficiencies within the prescribed period, not shorter than 7 days, with the instruction that failure to remove these deficiencies will leave the application without examination.

 

Refusal to grant approval:

According to Art. 23 the Act of August 5, 2022 on the transport of dangerous goods by air, the President of the Civil Aviation Authority refuses to grant approval in the event of a negative verification of the documents referred to in art. 22 paragraph 2 and 4. The refusal to grant approval shall be made in writing and served on paper or by fax, if the applicant indicates such an address for deliver - to the electronic address.

 

List of instructors:

After positive verification of the application, the instructor is entered into the list of instructors. This list is public and published on the website of the Civil Aviation Authority. Telephone number and e-mail address of the instructor are published only when the instructor attaches consent to the publication of this data with the application. An instructor is included on the list as soon as approval is granted.

 

List of instructors for information:

Based on Article 24 the instructor is obliged to notify the President of the Civil Aviation Authority of the change of the data published in the list of instructors within 14 days from the date of the change. The President of the Civil Aviation Authority takes into account the change in the data published in the list of instructors within 14 days from the date of receipt of the notification.

 

Expire of approval and removal from the list of instructors:

According to Art. 25 of the Act, the instructor is obliged to provide the President of the Civil Aviation Authority with a document confirming successful completion of the renewal training before the expiry date of the previous training. Failure to provide the President of the Civil Aviation Authority with a document confirming the successful completion of the renewal training on time, shall result in the instructor being removed from the list of instructors within 7 days from the date of expiry of this period.

In the event of a change in the Technical Instructions (Doc. 9284), pursuant to Art. 26 of the Act, the instructor is obliged to adapt the framework training program to this change and deliver it to the President of the Civil Aviation Authority before the commencement of the next training. Incompatibility the framework training program to the amendment of the Technical Instructions (Doc. 9284) and failure to deliver it to the President of the Civil Aviation Authority before the commencement of the next training will result in the approval becoming invalid and the instructor being removed from the list of instructors.

Pursuant to Art. 27 of the Act, an instructor is obliged to conduct training activities in accordance with the approval granted, under pain of removal from the list of instructors. The President of the Civil Aviation Authority shall remove an instructor from the list, if an instructor does not conduct training with the approval granted.
